Pledge of Allegiance

The Pledge of Allegiance was led by Mr. Matthews.

Consent Agenda

On the motion of Mr. Matthews, seconded by Mr. Weaver, which carried a vote of 5-0, the Commission approved the consent agenda, including the approval of agenda and the June 8, 2017 minutes.

Public Address

Mr. Purcell opened the public address period and asked if anyone wished to speak on issues not on this evening’s agenda. There being no one present who desired to speak, Mr. Purcell closed the public address period.

Public Hearings

CUP2017-05; CWS VII, LLC, Applicant; Louis E. & Delia L. Cornelius, Owners;  Thomas Murray, Agent

Mr. Timberlake presented to the members the request for the issuance of a conditional use permit (CUP) for a telecommunications facility. Mr. Timberlake stated the property is located between Mt. Airy Road (State Route 644) and Wesby Drive, just south of Fairview Lane in the Mineral Voting and Magisterial Districts and contains approximately 99.4 acres. Mr. Timberlake explained the applicant received approval for CUP2015-04 on July 7, 2015 to construct a telecommunications tower that expired on July 7, 2017. Mr. Timberlake stated the applicant has reached the maximum extensions allowed under the previous CUP and has submitted a new application due to the expiration. Mr. Timberlake noted there are no changes to the application or conditions.

 

Mr. Purcell opened the public hearing.

 

Ms. Hope McCreary, Agent, addressed the members and discussed the following:

·              Originally applied two (2) years ago;

·              Board of Supervisors approved those permits with timeline limitations;

·              Anticipated Verizon would install on the MICA site soon after 2015 approval;

·              Anticipated AT&T would install on the Mt. Airy site soon after 2015 approval;

·              Through site plan and building permit process, wireless carriers had a decrease in deployment of new sites in rural areas;

·              Cannot build structures without tenant per the County Ordinance;

·              Invested a lot in the development phase;

·              Mt. Airy site has no active interest at this time;

·              MICA site is back in Verizon's 2017 build plan; and

·              Committed to Verizon that site will be built by November of 2017.

 

Mr. Matthews asked for clarification regarding the ordinance not allowing a tower to be constructed without a tenant. Ms. McCreary explained one of the approved conditions stated if the tower is not operational for six months then the tower has be deconstructed. Ms. McCreary noted if there is no tenant, the applicant will not build.

 

Mr. Matthews inquired if the applicant has any towers in Louisa County. Ms. McCreary said yes, there are four (4) or five (5) operational towers located in the County.

 

Mr. Purcell closed the public hearing.

 

On the motion of Mr. Matthews, seconded by Mr. Quarles, which carried a vote of 5-0, the Commission agreed to forward the application to the Board of Supervisors with the recommendation of approval.

CUP2017-06; CWS VII, LLC, Applicant; County of Louisa, Owners; Thomas Murray, Agent

Mr. Timberlake presented to the members the request for the issuance of a conditional use permit (CUP) for a telecommunications facility on approximately 104 acres. Mr. Timberlake stated the property is located on the south side of Sacred Heart Avenue, about one-half mile from the intersection of Mica Road (State Route 700) in the Cuckoo Magisterial and Voting Districts of Louisa County. Mr. Timberlake explained the applicant received approval for a CUP2015-05 on July 7, 2015 to construct a telecommunications tower and expired on July 7, 2017. Mr. Timberlake noted there are no changes to the application or conditions.

 

Mr. Barlow asked for clarification that these are reapplications, not extensions. Mr. Timberlake confirmed.

 

Ms. Purcell opened the public hearing. There being no one present who desired to speak, Mr. Purcell closed the public hearing period.

 

On the motion of Mr. Matthews, seconded by Mr. Quarles, which carried a vote of 5-0, the Commission agreed to forward the application to the Board of Supervisors with the recommendation of approval.

New Business

Review for Conservation Easement for Conformance with Comprehensive Plan - Green Springs Timber, LLC & Virginia Department of Forestry (Buzzard's Roost)

At the request of staff, review of the Conservation Easement for Conformance with Comprehensive Plan (Green Springs Timber LLC) was postponed to the August 10, 2017 meeting.

On the motion of Mr. Matthews, seconded by Mr. Quarles, which carried a vote of 5-0, the Commission voted to adjourn the July 13, 2017, meeting at 7:13 p.m.
